Is the IRS Illegal??

OK, disclaimer here: By NO MEANS am I advising ANYONE to not pay their taxes. Nor, am I providing any LEGAL advice. I'm just pointing out something interesting I've found that I plan to investigate further.
Now that the disclaimer is out of the way, let me pick your brain. How many of you know how our Constitution get's amended? Well, after Congress proposes and votes on an Amendment, it goes to the states. Three-Forths of the states have to agree to before the amendment is ratified and becomes official.
Now, the IRS operates off the 16th Amendment:
"The Congress shall have power to lay and collect taxes on incomes,
from
whatever source derived, without apportionment among the
several
States, and without regard to any census or enumeration."
Well, according to Bill Benson, the amendment was never ratified by the states, and thus is not legal. He bases part of this on the fact that 3 states modified the amendment and then ratified their version of it. This is not legal, not within their power, and is NOT a ratification of the actual amendment.
In his book, "The Law That Never Was," he says that he has visited all of the state capitols and investigated this first hand. I would buy his book and read it myself, but it's $50. So, I did the next best thing. I sent a link over to "FoxReport@foxnews.com" and asked Shepard Smith and his team to look into it. Who knows, maybe you'll hear my name mentioned on "The Fox Report" (7pm EST) or "Studio B" (3pm EST) on Fox News! :-)
Hey, I'm all for getting rid of the IRS!!!!
